terms and conditions
Introduction
These Terms and Conditions govern the automated purchase of art prints through this website, as well as inquiries and separate manual purchases relating to our original painting portfolio. By placing an order or making an inquiry, you agree to be bound by these terms.
1. About Us
This website is operated by Veil of Grace Limited/Graceland London. Our registered business address is 15 Canfield Place, London NW6 3BT and company number 15880515 our contact email is art@gracelandlondon.com
By purchasing from this website, you agree to be bound by these Terms and Conditions.
2. Contract Formation
* For Print Purchases: When you place an order and pay via PayPal (including PayPal installment options), you are making an offer to purchase. A legally binding contract is only formed when we physically dispatch your print and send you a dispatch confirmation email. We reserve the right to cancel and fully refund any order prior to dispatch if there are stock shortages, printing errors, or pricing mistakes on the website.
* For Original Paintings (Email Inquiries): Artworks displayed within the original paintings portfolio are for showcase and exhibition purposes only. They cannot be purchased through the website’s automated shopping cart or PayPal checkout button. An email inquiry is an expression of interest only and does not constitute a purchase or a binding contract. A legally binding contract for an original painting is only formed once:
1. The price, bespoke delivery costs, and transit insurance have been mutually agreed upon via email.
2. A manual invoice or payment link has been issued directly to you by the artist.
3. Payment has been received and cleared in full.
3. Product Specifications & Availability
* Prints: Each print is sold subject to its product description, which details the print title, dimensions, paper type, and expected dispatch times. Please note that while we make every effort to display colours accurately, mockups and screens may vary slightly from the physical printed inks.
* Original Paintings: Many of the pieces shown in the original paintings portfolio represent past works and may already be sold, held in private collections, or otherwise unavailable. The display of any painting does not guarantee it is available for sale. Because originals are unique, physical characteristics, textures, and framing (if applicable) will be clarified during the email inquiry process.
4. Shipping & Delivery
* Print Dispatch: We dispatch prints within the timeframe stated on the print listing. In accordance with UK law, unless a longer period is expressly agreed upon upfront, all print orders will be delivered within a maximum of 30 days from the date of order confirmation.
* Original Painting Dispatch: Because original paintings are unique, fragile, and high-value items, they require bespoke packaging and specialist transit insurance. Shipping costs and delivery timelines for original paintings cannot be calculated at checkout. A custom shipping quote, including full transit insurance, will be calculated individually and provided to you via email before your purchase is finalized.
* Courier Restrictions: We cannot deliver to P.O. Boxes or certain remote territories. If a courier restriction applies to your address, we will contact you to arrange an alternative or issue a full refund.
5. International Orders, Customs, and Import Duties
All orders (both prints and original paintings) shipped outside of the United Kingdom may be subject to local import duties, taxes, Value Added Tax (VAT), and customs clearance fees levied by the destination country.
* Buyer Responsibility: As the customer, you are considered the "importer of record" and must comply with all laws and regulations of the destination country. All additional charges for customs clearance, duties, or local taxes are your sole responsibility. We have no control over these charges and cannot predict what they may be.
* Refused Shipments: If you refuse a shipment due to unexpected import fees, you remain responsible for the original shipping charges, any import fees incurred on the package, and the cost of returning the package to us. These fees will be deducted from your refund. If the return costs exceed the value of the artwork, the package may be abandoned, and no refund will be issued.
* International Shipping and Risk of Loss: We ship international orders using tracked courier services. While we provide estimated delivery windows, we cannot guarantee exact delivery dates due to potential customs delays, which are beyond our control.
* Transfer of Risk: The risk of loss and title for all artwork purchased pass to you, the buyer, the moment we hand the package over to the shipping carrier.
* Incorrect Addresses: We ship strictly to the delivery address provided at the time of checkout or expressly confirmed via email for original paintings. We are not responsible for packages that are delayed, lost, or misdelivered due to incorrect or incomplete address information provided by the buyer.
6. 14-Day Right to Cancel & Returns (UK & EU Only)
In accordance with the UK Consumer Contracts Regulations, you have the right to cancel your order for any reason within 14 days of receiving your physical goods. This applies to automated print purchases and available original paintings purchased via email.
* Exclusion for Commissions and Custom Work: If an email inquiry results in a bespoke commission, custom artwork, or any piece personalized to your specifications, the 14-day return policy does not apply. All sales for commissioned artworks are strictly final.
* How to Cancel: You must notify us via email within 14 days of delivery that you wish to return the artwork.
* Return Shipping Conditions & Costs:
* Prints: You must return the print securely in its original packaging within 14 days of your notification. You are responsible for the cost of return postage. We strongly recommend using a tracked service.
* Original Paintings: Because of their unique nature and high value, original paintings must be returned in their exact original condition and packed using the identical protective materials in which they arrived. The buyer is strictly responsible for organizing and paying for a tracked, fully insured courier service equivalent to the delivery service used by the artist.
* Refunds: We will issue a full refund (including standard outbound shipping costs) within 14 days of receiving the artwork back in its original, undamaged condition. Original shipping fees for international orders are strictly non-refundable.
7. International Returns and Currency
* Finality of International Sales: Due to the custom nature of art prints, the high value of original artwork, and the high costs of international transit, all international sales outside the UK/EU are final unless the item arrives damaged.
* International Return Costs: In the rare event that an international return or exchange is mutually agreed upon via email, the buyer is strictly responsible for organizing and paying for tracked, insured return shipping, as well as any duties incurred during the return process.
* Currency Fluctuations: All transactions are processed in GBP (£). We are not responsible for any variations in total price caused by exchange rate fluctuations or foreign transaction fees charged by your bank or PayPal.
8. Damaged or Faulty Items
If your print or original painting arrives damaged or faulty, please contact us via email within 3 working days (or 48 hours for high-value original paintings) with photographs of the damage to both the packaging and the artwork. Once verified, we will arrange a replacement print, repair coordination, or a full refund at no extra cost to you.
9. Payment & Installments
* Automated Purchases: Payment for prints is securely processed via PayPal. If you opt to use a PayPal installment or financing option (such as "Pay in 3"), your credit agreement is strictly between you and PayPal. Refunds for installment purchases will be issued back through PayPal, who will adjust your remaining credit balance accordingly. We hold no liability or oversight regarding PayPal's lending decisions or collection procedures.
* Manual Purchases: Payment for original paintings via email inquiries will be handled via a direct manual payment method (such as a secure manual PayPal invoice or bank transfer) as agreed upon during email correspondence.
10. Intellectual Property & Copyright
All copyright, digital assets, and intellectual property rights in the artwork remain strictly with the artist ([Insert Your Name/Business Name]). The purchase of a physical print or an original painting grants you ownership of that specific physical item only. It does not transfer any reproduction rights. You are strictly prohibited from copying, scanning, digitally altering, duplicating, reselling, or commercially exploiting the artwork or images from this website without explicit written permission from the artist.
11. Governing Law and Jurisdiction
These Terms and Conditions, and any disputes arising from your purchase, inquiries, or use of this website, shall be governed by and construed in accordance with the laws of England and Wales. You agree to submit to the exclusive jurisdiction of the courts located in England and Wales to resolve any legal matter arising from these terms.
